Terms and Conditions

This section sets out the roles and responsibilities of those involved in the service provided by Taxi Napoli 8888, to ensure clarity, transparency and the correct use of the platform.

Matching supply and demand for taxi services

Since the customer and the taxi driver have agreed, respectively, to use and to provide the taxi journey, the booking service is essentially complete, subject to the assistance still provided by Taxi Napoli 8888 to resolve any issues, which are summarised below by way of example and are not exhaustive: delay or permanent inability of the taxi to provide the service due to an accident, vehicle breakdown or other causes; a replacement journey; the customer not being present at the specified address; personal belongings and other items left in the taxi.

Once the booking process provided by Taxi Napoli 8888 has been completed, the taxi service begins, involving, on the one hand, the customer, who boards the taxi, and, on the other, the taxi driver. In fact, by law, the service of transporting passengers and luggage by taxi is the exclusive competence and responsibility of individual taxi drivers, each of whom holds their own licence and is either the owner or lessee of their taxi, with whom customers enter into a transport contract on a case-by-case basis. This applies not only when the customer makes a booking via the Taxi Napoli 8888 dispatch centre, but even more so when the customer boards a taxi parked in the designated reserved parking areas, or one that is in transit. Consequently, Taxi Napoli 8888 is not a carrier, nor a hire company, either directly or through third parties; it is not an employer, nor the principal of its affiliated taxi drivers. Generally speaking, Taxi Napoli 8888 is not, under any circumstances, liable for the conduct of the taxi driver during their shift or at any other time.

This does not, of course, mean that Taxi Napoli 8888 takes no interest in the conduct of its members, who must in any case adhere to a specific set of internal regulations, compliance with which is constantly monitored by a Disciplinary Committee, to which customers may submit complaints or reports. In addition to their internal contractual liability towards Taxi Napoli 8888, taxi drivers are, by law, subject to specific disciplinary liability in the course of their professional activities, which is in addition to their civil and criminal liability under ordinary law. The law entrusts the relevant authority to the local authority that issued the taxi licence, not to the companies that act as intermediaries for taxi journeys.

In Naples, the body responsible for disciplinary matters is the Central Directorate for Infrastructure, Public Works and Mobility – Public Transport Services, with its offices at Via Alessandro Poerio 21 – 80139 Naples, Tel. 0039 0817952921 – Fax 0039 0817922936 – trasporto.pubblico@comune.napoli.it – www.comune.napoli.it/servizinondilinea. Anyone who has requested or taken a journey using a taxi in Naples – whether or not they are a customer of a company providing a booking service – may contact this body.
